Appeal Revived In Lawsuit Over Transgender Woman In Gym Locker Room

MIDLAND (WWJ/AP) - The State Court of Appeals has been told to take another look at a lawsuit from a Midland woman who claims her rights were violated after seeing a transgender person at her fitness gym's locker room.

Yvette Cormier's membership at the Planet Fitness Club in Midland was terminated in 2015 after she warned other women about a transgender woman at the club. Planet Fitness told her it allows people to use the locker room that matches their identity as part of a “no-judgment policy.”

While the appeals court last year found no evidence of sexual harassment -- noting that Cormier and the transgender woman were both wearing clothing -- the state Supreme Court said the lower bench should have considered Cromier's claims under the Michigan Consumer Protection Act.
