Man To Stand Trial For Murder In Shooting Death Of 3-Year-Old On Southfield Freeway

DETROIT (WWJ) - A 24-year-old man who allegedly shot into a car on a Detroit freeway during a case of road rage, killing a 3-year-old boy, has been ordered to stand trial for murder.

Derrick Durham was bound over for trial Friday on a charges of open murder; firearms – discharge from vehicle causing death; firearms – possession by felon; felony firearm – three counts; and habitual offender third - offense in the death of 3-year-old Christian Miller.

Miller was shot January 24 while riding in his godmother's SUV on the Southfield Freeway near Joy Road on Detroit's west side. The pair was on their way to see "Sesame Street Live." He was struck between the shoulder blades and died the next day.

Durham's defense attorney argued that he should be tried on a lesser charge of manslaughter because he didn't know children were in the vehicle, he didn't intend to shoot the child, and he was provoked by the boy's godmother when she cut him off. 

Durham is due back in court Feb. 22. He remains jailed without bond.
